Court Required Custody Mediation
In California, the parties are required to attend custody mediation (sometimes referred
to as “Conciliation Court”) prior to the judge being able to make an order concerning
child custody. This mediation is held at the courthouse with a court-
Mediation in Los Angeles County
Los Angeles County is a confidential county, meaning that nothing that is said or discussed in the mediation session will be disclosed to the judge who will ultimately be making the custody orders in the case in the event the parties are unable to agree upon a parenting plan in mediation.
Mediation in Ventura County
Ventura County, on the other hand, is a “recommending” county. Should the parents not agree on a custodial plan in mediation, the mediator will testify before the judge and make a recommendation as to a temporary parenting plan. The judge may or may not make orders consistent with the mediator’s recommendation.
Preparation is Key in Mediation
It is vitally important that parents be prepared to present themselves well at the court required custody mediation. This venue is often the one in which initial parenting plans are implemented and these temporary or “pendente lite” custody plans often remain in place for significant periods of time.
