Benefits of Alternative Dispute Resolution (ADR)
Traditional litigation is sometimes necessary, but there are many reasons why mediation and collaborative law are in our clients' best interests:
- Traditional litigation is expensive and time-consuming. Mediation and collaborative law offer less costly, more efficient options for families.
- Trials are emotionally draining for everyone involved. ADR allows you to work together to set aside the emotional struggles as much as possible and reach cooperative agreements between the parties involved. Mediation and collaborative law are important options when children are involved.
- Most importantly, ADR offers opportunities for families to reach solutions that work for them. If you bring a divorce or child custody dispute to trial, the judge only has a few options. If you work with the other party through mediation or collaborative law, you can address both of your unique needs to reach a solution that is in your and your family's best interests.
The Different Forms of ADR
There are many ways to approach alternative dispute resolution. With regard to family law, mediation and collaborative law are the most common and effective.
Mediation is less structured than collaborative law. Parties can meet in the same room or work with their attorneys to come to a resolution.
As attorneys, we are available to represent clients in mediation. Additionally, Heidi Lauer is a qualified mediator. She frequently volunteers as a Family Law Mediator for the Los Angeles County Superior Court.
In collaborative law, each party agrees to reach a solution outside of the courtroom. If cooperative negotiations fail, both parties will need to get new attorneys and start the process over.
