Physical Custody

A physical custody determination concerns which parent the child will actually physically live with.  Although parents may be awarded joint physical custody, the actual amount of time each parent has the primary care and responsibility for the child may be vastly different depending upon the circumstances, which include the suitability and appropriateness of each parent’s parenting skills and the age and health of the children, etc. California courts are required to make custody decisions which are “in the best interests of the child.”  A further legislative directive states that absent compelling reasons, a child should have “frequent and continuing contact with both parents.”
